      • ​WHEREAS, Developer has advised the City that certain financial incentives from the City would induce the Developer to construct or cause to be constructed on the Property a Standard Service restaurant, comprised (in the aggregate) of approximately between 5,000 and 8,000 square feet of space, along with outdoor amusement activities such as outdoor gaming (the "Project");

      • "Chapter 380 Grant(s)" shall mean the

        • (a) waiver of City permit, inspection and development fees, as provided in Article V. herein, and

          • ​​5.01 Chapter 380 Waivers... the City agrees to waive City permit, inspection and development fees (the "Chapter 380 Waivers"), in an amount not to exceed Twenty Thousand Dollars ($20,000.00) (the "Chapter 380 Waivers Maximum")..

        • (b) the rebate to Developer of Ad Valorem Tax Revenues received by the City on the Improvements constructed by Developer on the Property as provided in Article V. herein; and

        • (c) the installation of a lift station and extension of a sewer main near the Property to support sewer services to the Property as provided in Article V. herein.

          • 5.04 Construction of Lift Station... the City shall construct and install a lift station and extend approximately I, 750 linear feet of forced sewer main, in sizes, capacities and locations as determined by the City in its reasonable discretion, to an area adjacent to and/or near the Property as is depicted in attached Exhibit "C", no later than thirteen ( 13) months after the Effective Date of this Agreement; provided, that if the City is delayed in completing such construction beyond thi1teen ( 13) months after the Effective Date of this Agreement then the three (3) year time period for the Chapter 380 Payments under this Agreement shall extend on a month-for-month basis until such construction is completed. Developer shall be responsible, at its sole cost and expense, for extending its service line to the point of interconnection with the City's sewer main and for the payment of any tap fees.

      • 2.01 The term of this Agreement shall begin on the Effective Date and shall continue in effect until the earliest to occur of: (a) all Chapter 380 Grants have been made by the City pursuant to Sections 5.0 I and 5.02 of this Agreement; or (b) December 31, 2026, unless sooner terminated as provided herein.

      • 4.0 I (12) Developer shall ... (ii) obtain a certificate of occupancy from the City for the Project no later than twenty-four (24) months after the Effective Date of this Agreement; and (iii) be open for business to the public no later than thirty (30) months after the Effective Date of this Agreement; and (iv) remain continuously open for business to the public for the term of this Agreement.

      • 4.01 12 (d) Prior to obtaining a building permit to start construction on any Improvements on the Property, Developer agrees that it shall apply for and obtain planned development district zoning for the Property on terms and conditions recommended by the City's Planning and Zoning Commission and as approved by the City Council.

  • 08 March 2022, The Community News > Advertisement For Bids Public Hearing Notice City Of Willow Park Bankhead Sewer Extension .in pdfSeparate sealed bids for the construction of BANKHEAD SEWER EXTENSION will be received by the City of Willow Park, Texas, until 3:00 PM, on Wednesday, April 6, 2022, at City Hall, 516 Ranch House Road, Willow Park, Texas 76087, and then at said location publicly opened and read aloud. This project consists of furnishing and installation of approximately 1,850 linear feet of 6-inch SDR 26 PVC force main, 435 linear feet of 14-inch bore and encasement, and 95 linear feet of encased sewer line, lift station, and associated appurtenances.... The project to be constructed will be financed with assistance from the American Rescue Plan Act and is subject to all applicable Federal and State laws and regulations. Attention is called to the fact that not less than, the federally determined prevailing wage rate, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual orientation, gender identity, or national origin. Adherence to the grant recipient’s Section 3 Policy is required for all contracts and subcontracts

    • Background:: During previous deliberations, Council has authorized staff to prepare a Chapter 380 Agreement with UNCO for a restaurant / amusement and entertainment concept to be located along the South Frontage Road of IH 20, near the new TCA Athletic Complex currently under construction.The deal points include:

      • Connectivity to the City of Willow Park Wastewater System 

      • Waiver of all inspection fees and permits up to $20,000 

      • Rebate on 100% of Ad Valorem Taxes for a 3 year period

    • 3. Discussion/Action: to authorize the Mayor's signature on a Chapter 380 Agreement between the City and Unco. [Video2 after Executive Session]  After reconvening from Executive Session at 8:20 P.M.; Councilman Crummel motioned to authorize the Mayor's signature on a Chapter 380 Agreement between the City and Unco and Councilman VanSant seconded the motion. The vote to approve the motion was unanimous.
